Governor Kate Brown’s March 8, 2020, Emergency Executive Order based on “14 presumptive cases…violated emergency law, ORS 401.165(1)(2) and (5) in that her emergency declaration could not shut down every square inch of Oregon and the Pacific Ocean.
Brown mentioned in it that two counties asked for her to declare an emergency. Brown doesn't name the counties. A records request has been made to obtain such records, if they exist.
Brown had a quickie Executive Order September 25, 2020 and rescinded it 2 days later on September 27, 2020 claiming she consulted with "incident commanders". What they said we don't know, Brown made no mention of it when rescinding this emergency order.
The two years plus optics in downtown Portland showed visually an on-going emergency being in progress. Why could she not see that?
In the middle of that emergency order Brown made another just for the Proud Boys. It takes two to clash, but Brown doesn't mention any other group, like, maybe, perhaps Antifa? Brown never made an emergency declaration on Antifa.
And which Multnomah County elected official asked Brown to declare an emergency. Brown doesn't mention anyone in this Executive Order dated September 26, 2020.
Brown ended “all pandemic restrictions” on June 25, 2021.
Court of Appeals comments on September 29, 2021 lined up with that.
Brown resurrected the original “emergency” declaration from March 8, 2020 and dated it December 21, 2021.
On a roll the governor declared, two days later, on December 23, 2021, a declaration of a snow emergency for the state, but apparently did not tell ODOT as there was no snow emergency information on their website.
Brown’s Executive Order is declared for December 24, 2021, through January 3, 2022.
The revised Portland weather forecast as of December 24, 2021, predicted snow for only one day in the next 7 days, and that’s on December 28th.
